1. Acceptance of Terms

By creating an account or using Creative Foundry Pte. Ltd.’s ("we," "us," "our") website and services (the "Service"), you ("you," "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Our Service provides users with the ability to:

• Create accounts to access and download digital photographs taken at sporting events
• Browse and download their personal sporting event photographs
• Receive marketing communications and newsletters (with consent)

3. User Accounts

3.1 Account Creation

• You must provide accurate and complete information when creating your account. Any information provided by you will be governed by our Privacy Policy
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 18 years old to create an account

3.2 Account Responsibilities

• You are solely responsible for all activities under your account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts without notice for violations of these Terms

4. Use of Service

4.1 Permitted Use

• Access and download photographs of yourself from sporting events
• View and manage your account information
• Receive communications you have consented to

4.2 Prohibited Use

You may not:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Distribute, modify, or create derivative works of downloaded photographs for commercial purposes
• Share your account credentials with others

5. Intellectual Property Rights

5.1 Photograph Rights

• Photographs available through our Service are provided for your personal, non-commercial use only
• We retain all intellectual property (including copyright) and/or any moral rights to the photographs unless explicitly transferred to you under the terms of a separate agreement
• You may download and use photographs of yourself for personal, non-commercial, purposes
• You may not redistribute, sell, or commercially exploit downloaded photographs without written permission
• Any unauthorized use of photographs may result in legal action
• Commercial use of photographs requires separate written permission from us, such permission to be provided or withheld at our own discretion
• You may not use the Service to download photographs of other people unless you have their express consent
• If, at any time, you wish us to remove photographs of you from the Service then you should contact us at the email address below and we shall endeavour to remove such photographs identified by you: hello@creativefoundry.sg

5.2 Service Content

• All content, features, and functionality of our Service are owned by us and protected at law (including, without limitation laws relating to database rights, copyright and other intellectual property rights)
• Our trademarks, logos, and service marks are our property

5.3 Third-Party Rights

• We make reasonable efforts to ensure we have rights to distribute photographs
• However, we cannot guarantee that all photographs are free from third-party claims
• You use photographs at your own risk regarding potential rights violations

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your personal data is governed by our Privacy Policy, which forms part of these Terms. By using our Service, you consent to the collection and use of your information as described in our Privacy Policy.

7. Marketing Communications

7.1 Consent

By creating an account, you may opt-in to receive marketing emails and newsletters. You can withdraw your consent at any time by:

• Clicking the unsubscribe link in our emails
• Updating your preferences in your account settings
• Contacting us directly

7.2 Withdrawal of Consent

• Cease operations entirely

9. Limitation of Liability

9.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY SINGAPORE LAW:

• Our total liability to you for any claims arising from your use of the Service shall not exceed SGD $100
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• We shall not be liable for any loss of profits, data, use, goodwill, or other intangible losses
• This limitation applies regardless of the legal theory on which the claim is based

9.3 Free Service Exception

Given that our Service is provided at no cost to users, our liability is further limited to the greatest extent permitted under Singapore's Unfair Contract Terms Act.

9.4 No Liability for Changes

We shall not be liable for any losses resulting from Service modifications or discontinuation, including:

• Loss of access to photographs
• Inconvenience or disruption to users
• Need to find alternative services

9.5 Reasonableness of Terms

The limitation and exclusion clauses in these Terms have been drafted to be reasonable under Singapore law, considering:

• The free nature of our Service
• The availability of alternative photograph services
• The relatively low risk nature of our Service
• Users' ability to obtain insurance for important photographs

10. Medical and Safety Disclaimers

10.1 Event Participation

• We are not responsible for any injuries or incidents that occur during sporting events
• Photographs may capture accidents, injuries, or unsafe situations
• We are not medical professionals and make no health-related recommendations

10.2 Photograph Content

• Photographs may contain depictions of physical activity, competition, or sports-related incidents
• We do not warrant the accuracy of any health, safety, or medical information that may be visible in photographs

11. Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, internet failures, or technical issues with third-party services.

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us or using account settings.

12.2 Termination by Us

We may terminate or suspend your account immediately and without notice if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse the Service or other users

12.3 Effect of Termination

Upon termination:

• Your right to access the Service will cease immediately
• We may delete your account and associated data
• Provisions regarding limitation of liability and intellectual property will survive

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of Singapore.

13.2 Dispute Resolution
